The Fontaine (the “Company” or “we”) is concerned about privacy issues and wants you to be familiar with how we collect, use and disclose information. This Privacy Policy describes our practices in connection with information that we collect through your (“User” or “you”) use of this website, your use of any affiliated third party websites that may contain a link to this Privacy Policy, or to any pages, facilities, services, or capabilities accessible on or by any top-level The Fontaine domain owned by us, as well as software applications made available by us for use on or through computers and mobile devices (the “Apps”) (each, a “Site” and collectively the “Sites”), and through HTML-formatted email messages that we send to you that link to this Privacy Policy (collectively, the “Services”). By providing Personal Information to us, you agree to the terms and conditions of this Privacy Policy.

Important Information

This Privacy Policy aims to give you information on how the Company collects and processes your Personal Information through your use of its Apps and Services, including any data you may provide when you make a booking reservation, or take part in a competition.

The Company’s Apps and Services are not intended for children and we do not knowingly collect data relating to children.

It is important that you read this Privacy Policy together with any other privacy notice or fair processing notice we may provide on specific occasions when we are collecting or processing your Personal Information so that you are fully aware of how and why we are using your Personal Information. We are not responsible for the information collection, use and disclosure policies and practices (including the data security practices) of other organizations, such as Facebook, Apple, Google, Microsoft, RIM or any other app developer, app provider, social media platform provider, operating system provider, wireless service provider or device manufacturer, and we encourage you to check the applicable privacy policy to determine how these linked sites will handle any of your Personal Information.

2.       At any time, you can contact us through info@thefontainehotel.com or the address or telephone number provided below to unsubscribe from the service and opt-out of our right per your consent under the terms of this Privacy Policy to share your Personal Data. 

We will try to comply with your request as soon as reasonably practicable.  Notwithstanding anything else in this Privacy Policy, please note that we always reserve the right to contact you in the event of a change in this Privacy Policy, or to provide you with any service related notices.

How you can access, change or suppress your Personal Information  

If you would like to review, correct, update, suppress or delete Personal Information that you have provided to us, contact us at the address below.  In your request, please make clear what Personal Information you would like to have changed, whether you would like to have the Personal Information you have provided us suppressed from our database, or otherwise let us know what limitations you would like to put on our use of the Personal Information you have provided us.  For your protection, we may only implement requests with respect to the Personal Information associated with the particular email address that you use to send us your request, and we may need to verify your identity before implementing your request.  We will try to comply with your request as soon as reasonably practicable.  

Please note that we may need to retain certain information for recordkeeping purposes and/or to complete any transactions that you began prior to requesting such change or deletion.  There may also be residual information that will remain within our databases and other records and which will not be removed.

RETENTION PERIOD

We will retain your Personal Information for the period necessary to fulfill the purposes outlined in this Privacy Policy.  Processing is therefore necessary for the purposes of our legitimate interest, unless a longer retention period is required or permitted by law.  

USE OF SERVICES BY MINORS

The Site is not intended for use by children.  We do not intentionally gather Personal Information about visitors under the age of 16, and we request that they not provide Personal Data through the Services.  If a child has provided us with Personal Data, a parent or guardian of that child may contact us to have the information deleted from our records. The Services are controlled and operated by us from the United States and are not intended to subject us to the laws or jurisdiction of any state, country or territory other than that of the United States.  Your Personal Information may be stored and processed in any country where we have facilities or in which we engage service providers, and, by using the Services, you consent to the transfer of information to countries outside of your country of residence, including the United States, which may have different data protection rules than those of your country.

No fee usually required.

You will not have to pay a fee to access your Personal Information (or to exercise any of the other rights). However, we may charge a reasonable fee if your request is clearly unfounded, repetitive or excessive. Alternatively, we may refuse to comply with your request in these circumstances.

What we may need from you

We may need to request specific information from you to help us confirm your identity and ensure your right to access your Personal Information (or to exercise any of your other rights). This is a security measure to ensure that Personal Information is not disclosed to any person who has no right to receive it. We may also contact you to ask you for further information in relation to your request to speed up our response.

Time limit to respond

We try to respond to all legitimate requests within one month. Occasionally it may take us longer than a month if your request is particularly complex or you have made a number of requests. In this case, we will notify you and keep you updated.

The “LAST UPDATED” legend at the top of this page indicates when this Privacy Policy was last revised.  If there are any material changes to this Privacy Policy or our information practices change in the future, we will notify you by posting the changes to the Apps or the Services.  Any changes will become effective when we post the revised Privacy Policy on the Apps or the Services.  Your use of the Apps or the Services following these changes means that you accept the revised Privacy Policy.
